Kiyo Terms of Service
At a glance
- Kiyo is free to use today. If we add paid features, we will show what they include and what they cost on the purchase screen before you buy.
- You must be 14 or older to use Kiyo.
- What Cycle Syncing shows you is for reference. It is not medical advice, and it must not be used for birth control or to plan a pregnancy.
- Records kept only on your device cannot be recovered by us. They can be lost if you delete the app or change devices, so we recommend signing in and syncing anything you want to keep.
The summary above is part of the full terms below. Where they differ, the full terms govern.
1. About these terms
Kiyo is a personal planner app and website operated by νλ‘μ νΈμ€λΌμ΄ ("Kiyo", "we", "us"). These terms are the agreement between you and us for your use of the Kiyo app and the related services we provide on any device β phone, tablet, computer or web browser (together, the "Service").
You can use the Service without creating an account. If you do, you accept these terms by installing or using the Service. If you create an account, you accept these terms when you agree to them and sign in with a Google or Apple account.
Throughout these terms, "Cycle Syncing" means the optional feature that shows cycle phases and general reference information based on the menstrual cycle records you enter, and "paid features" means any service or feature we offer for a fee (such as removing ads).
2. Who can use Kiyo
The Service is for people aged 14 and over. If you are under 14, you may not create an account or use the Service.
We may decline to open an account, or close one afterwards, if you are under 14, if you use someone else's account or information, if you use the Service for fraudulent or commercial purposes, or if your registration otherwise breaks the law or these terms.
3. Health information β this is not medical advice
The cycle phases, predictions and reference information that Cycle Syncing shows are estimates calculated from the records you enter, and they may not match what is actually happening in your body.
Everything the Service provides is for general reference only. It is not a medical diagnosis, treatment or prescription, and it does not replace consulting a healthcare professional.
Kiyo's cycle predictions must not be used as a method of birth control or to plan a pregnancy.
"Cycle Syncing" is not a clinically validated method, and how much the menstrual cycle affects the body varies widely from person to person. If you have pain, unusual symptoms or any other health concern, please consult a healthcare professional.
4. Your account
Account sign-in is handled through your Google or Apple account, and keeping that account secure is your responsibility.
If you learn that someone else is using your account, tell us right away and follow the steps we give you. If you do not tell us, or you do not follow those steps, we are not responsible for what results, except where we acted intentionally or with gross negligence.
5. Privacy
How we handle personal information is described in our Privacy Policy, which applies together with applicable law.
Menstrual cycle records and other health information are treated as sensitive information and are processed only if you give separate consent. If you use Kiyo without an account, the records you enter stay on your device and are not sent to us.
We maintain security measures to protect personal information, and we publish and follow our Privacy Policy.
6. What Kiyo provides
The Service includes:
- recording and managing tasks, events, notes and habits;
- Cycle Syncing (optional);
- syncing across devices and use of the web version (account holders);
- Google Calendar and Google Tasks integration (account holders, optional); and
- any other service we develop or provide, including through partners.
We aim to keep the Service available 24 hours a day, every day, but availability may be limited for operational or technical reasons.
We may change all or part of the Service where there is good reason to do so. If a change is significant or unfavorable to you, we will give notice in advance. We may suspend the Service temporarily for maintenance, repairs or replacement, for network failures, or for events beyond our control β normally with advance notice, and afterwards where that is not possible. If we discontinue the Service altogether, we will post notice in the Service 30 days in advance.
We make reasonable efforts to address feedback and complaints about the Service, and we may reply through our contact channel with how a matter was handled.
7. Your records, syncing and backups
If you use Kiyo without an account, all of your records are stored only on your device. They can be lost if you change devices, delete the app, reset the device, or clear your browser data, and we cannot recover data that was stored only on your device.
If you use the web version, browser storage may be cleared by the browser itself after long periods without a visit. We recommend signing in and syncing anything you want to keep.
If you have an account, your synced data is stored on the cloud servers we use, and it is deleted in line with our Privacy Policy when you delete your account.
The records you enter remain yours. We process them only as needed to provide the Service β storing them, syncing them and displaying them.
8. Connecting Google Calendar and Google Tasks
If you have an account, you can choose to connect Google Calendar and Google Tasks. When you do, that provider's own terms and privacy policy also apply.
Events and tasks brought in through the connection originate in that external service, and adding, deleting or completing them in Kiyo may be reflected back there, depending on your settings. You can disconnect at any time in Kiyo's settings or in your Google account security settings.
We are not responsible for the connection being limited or interrupted by problems or policy changes in the external service itself, except where we acted intentionally or with gross negligence.
9. Advertising
We may show ads in the Service.
We do not use your menstrual cycle records or other health information to select, show or target ads, and we do not provide that information to advertisers or any other third party.
If you deal with an advertiser through an ad shown in the Service, that is between you and the advertiser. We are not responsible for it, except where we acted intentionally or with gross negligence.
10. Paid features
We may offer paid features such as removing ads. What a paid feature includes, what it costs, how it is billed and how long it lasts are shown on its purchase screen.
Payment is handled by the app store you bought it through (Apple App Store, Google Play and the like), and cancellations and refunds follow applicable law and that store's policies. Withdrawal of purchase and cancellation of a subscription are handled under applicable consumer protection law and the app store's own process. If we introduce a paid feature or change one, we will post notice in the Service in advance.
11. What you agree not to do
You agree not to:
- use someone else's information or account;
- change information we have posted without permission, or collect, copy or distribute the software or data that makes up the Service without permission;
- access or use the Service in ways we have not provided for β abnormal API calls, automated access, reverse engineering and the like β except as the law allows;
- deliberately interfere with the operation of the Service;
- infringe our intellectual property rights or anyone else's; or
- do anything else unlawful or improper.
You also agree to follow applicable law, these terms, the in-app guidance and any cautions we post about the Service.
12. Intellectual property
Copyright and other intellectual property rights in the Service and in the content we create belong to us. You may use the Service for your own personal, non-commercial purposes; without our prior consent you may not copy, transmit or distribute the Service or its components, or create derivative works from them.
Rights in the records you enter remain yours, as described in "Your records, syncing and backups" above.
13. Ending your account, and suspension
You can close your account at any time from the account controls in Kiyo's settings or through our contact channel. When you do, the data stored on our servers is deleted in line with our Privacy Policy.
If you break the commitments in "What you agree not to do", we may limit your use of the Service or close your account after giving notice β or immediately, with notice afterwards, where urgent action is needed. If you think that was wrong, you can raise it through our contact channel, and we will restore your access if we agree.
14. Liability
If either of us breaks these terms and causes the other loss, the party at fault is responsible for it.
Except where we acted intentionally or with gross negligence, we are not responsible for:
- failures caused by events beyond our control;
- problems using the Service that are caused by you;
- loss of data that was stored only on your device (see "Your records, syncing and backups");
- decisions or actions you take in reliance on the predictions and reference information the Service provides (see "Health information"); or
- loss caused by interruption of a service we provide free of charge.
We are also not responsible for disputes between users, or between a user and a third party, that arise through the Service, except where we acted intentionally or with gross negligence.
15. Changes to these terms
We post these terms where you can reach them easily β in Kiyo's settings or a screen linked from it.
We may revise these terms as long as the revision complies with applicable law. When we do, we will post the revised terms on our website (kiyoplanner.com) together with the current ones, stating the effective date and the reason, at least 7 days before that date β and at least 30 days before, if the change is unfavorable to you.
If you keep using the Service after the effective date, the revised terms apply to you. If you do not agree to them, you can stop using the Service and close your account as described above.
16. Governing law and disputes
These terms are governed by the laws of the Republic of Korea. If you live outside the Republic of Korea, this does not take away the protections given to you by mandatory consumer protection laws where you live.
Any lawsuit between you and us relating to the Service is brought in the court having jurisdiction under the Korean Civil Procedure Act.
These terms were written in Korean, and translations may be provided. If a translation differs from the Korean version, the Korean version controls.
